I don't know enough about the case to comment specifically, but it's always interesting to see just how much the general public struggle with concepts such as innocent until proven guilty and beyond reasonable doubt.

Most cases of 'culpable homicide' in SA don't carry a custodial sentence, which means he probably won't see any jail time. So he basically gets off scot free for killing his girlfriend.

Jesus, SA law sucks. How do you prove someone intended to kill someone, in there absence of a confession or video evidence? You could just argue you were playing around with a gun and didn't realise it was loaded, or even better, blame it on the toilet door. Surely the fact alone he had a gun and it had bullets in it, and he pulled the trigger and the bullets went into Reevas brain and exploded it to bits is evidence? Seems that little fact gets forgetting amidst all the arguments about which way he rolled out of bed or whether he wire his prosthetics that day.

Remember that South African woman who hired an hitman to murder her daughters Rugby playing celebrity boyfriend and she got off scot free because it was successfully argued she had children young and didn't go clubbing enough. I'm pretty sure most court rulings in SA are decided by backroom deals paid with either money or free blowjobs.

Why didn't he just ask who was in there?
Why would his first thought be that it must be an intruder instead of having the logical thought of it probably being his GF.
Then without knowing who was in there, why fire not 1 but 4 shots into a small bathroom

Look, I'm almost certain that he intended to murder his girlfriend. However, since there is no way of actually proving that he intended to murder her beyond a reasonable doubt, he cannot be charged with murder.
It sucks, but that's the best way to run a legal system. You can't run it on a system of hunches and what you personally think happened. It's all about evidence and proof, and unfortunately this case is lacking enough of this to justify a murder charge.

Because if there was an intruder, asking who is there makes you very very vulnerable. In a place like South Africa, saying that to an intruder would most likely be your last words. On the shots part, Im not sure on what the legal findings where but I read something about the gun expert making comments about the type of gun and the time between shots being very small. And why shoot 4? I think thats anything from genuine intent to want to kill whoever was there or just plain fear. (thats a bit of heresay though) But it was in a bedroom that he shared with his GF. If you were in the same position wouldn't you first think to check it wasn't your partner ? And the "intruder" was behind a closed door, so the immediate threat was diminished and Oscar had the upper hand.

She's South African herself so she's no surprised by any of this, but regardless of what a fucked up nation it is, if you wake up in the middle of the night and you hear noises in your apartment, wouldn't the first thing to do would be to check if your girlfriend was lying in bed next to you . If she wasn't, you'd surely call out and double check. My GF did point out the same thing as RedKat in that by calling out (if there was a burgler with a firearm) you'd probably wind up a lead blanket yourself, but in a country were personal firearms are more "normal" and routinely kept close to ones side, surely at the very worst you'd pull your gun out, take cover and then call out. Either way, my girlfriend and I both have come to the conclusion that Oscar Pistorious is a mentally deranged individual. To shoot somebody as ridiculously hot as she was, you have to be mad in the head. :lol: :lol: :lol:
