Bendigo residents Julie Hoskin and Kathleen Howard were seeking leave to appeal against the Victorian Civil and Administrative Tribunal's (VCAT) decision to uphold the local council's planning approval for the mosque in August.

But the Victorian Appeals Court today refused their last bid to stop the project.

Speaking after the decision, Ms Hoskin said she would seek more legal advice, but wanted to take the matter to the High Court.

Approval for the mosque led to controversy and some divisions within the town.....

There are no grounds to oppose it unless:

- It does not meet community expectations (i.e. you can't build a 36 storey tower where there are only 1 or 2 level houses)
- It does not fit the architecture of the area.
- If the Bendigo Council decides to be difficult because they can

The second point is a big one. If they did a shade study and a minaret casts a shadow over a house or two, it is a legitimate reason to stop it. On the GC, a development we were working on did not pass the final DA stage due to the shade study casting a shadow over neighbouring single storey residences.

People were opposed to it for one reason only. And we all know what that reason is. Hell people build churches all the time and nothing is ever said about parking issues

Do Mosques in Australia broadcast the 4:30 am morning call to prayer at the same volume that they do in Muslim countries? After all the purpose is to wake people up to go to the mosque.

Ballarats mosque hasn't had an issue getting up this year. We have 65 Muslim families and well over 100 Muslim Uni students who come here, they deserve a place of worship like anyone else.

The majority don't. Part of the approval of this Bendigo mosque, is that the call to prayer must be at a volume low enough that it can not be heard outside of the grounds of the mosque.
