"In sentencing Justice Lex Lasry told D'Angelo it was a tragedy he had not reached for his phone instead of a loaded gun.
"The fact that his death was so avoidable in so many ways makes it all the more tragic," said Justice Lasry.
"No reasonable person should ever point a gun at another person and pull the trigger."
The court heard D'Angelo had consumed up to 42 stubbies of beer and as many as 35 bongs of marijuana in the hours leading up to the shooting."

Yeah he's clearly culpable, not in imminent personal danger, heavily intoxicated, and admitting he was unaware of the condition of his weapon. Jail time is warranted.

Could've fired a warning shot could've called a cop, instead he killed a man and is trained to hit a target. Impeared by drugs and alcohol doesn't give you the right to kill another human. Not even if they're stealing from you.

Disgraceful. Agree it's disgraceful, he should have got twice as much for murdering someone whilst under the influence of alcohol and drugs.

You guys are pathetic.
This man gets 8 years for defending his livelihood and himself from thugs.
Being drunk in your own property is not even a crime.

Being drunk in your own property is not even a crime. Being in possession of a deadly weapon after a night of getting fucked up on alcohol and billies is just as bad being in the same state behind a wheel. Someone always ends up dead. Even if he got something stolen, it probably could be claimed on insurance and it was not like his life was in danger ffs. This is why people like Gun Control because there is no guarantee that the fuckwits who own them are capable of utilising reasonable decision making skills to responsibly use them. A criminal forfeits their right to life as soon as they invade your home. You have no way of knowing whether or not they intend you harm, and thus you have reasonable cause to use lethal force. Would you rather use lethal force on somebody invading your home to protect yourself and your family, or would you rather take the chance that they may not intend you any harm? Would you rather kill the guilty in self-defense, or gamble on them not harming the innocent?

Agree nothing wrong with owning a gun . Just don't be a fuck wit with it . Why do you think guns and ammo have to be under lock and key . I know a person who has guns as he is a hunter . He has his guns hidden and his ammo in a separate area and is only known to him . He doesn't want his kids to know where they are .

Would you rather kill the guilty in self-defense, or gamble on them not harming the innocent? Generally if someone is going to invade my house, they are more likely after something like my TV or something material item that I really am not going to care much about (It will all be insured anyway). I'd rather they just take that and leave, then escalate potentially escalate a conflict beyond my control and further endanger my family. If someone actually attacks me or my family with intent to cause grievous bodily harm then i'd have no hesitation in killing in self defence but going out to kill them first is just a sick mindset. Proper home security like deadlocks, secure windows and alarm systems is going to do more to deter potential robbers away from targeting my house than the chance that I might fight back ffs. The reality is though that break ins are low in both the parts of Melbourne and Brisbane where i live and Australia is not the United States. The chance of you getting your house broken into by armed criminals is nowhere near as high, so being utterly paranoid about needing to protect your house is stupid. Your thirst for blood and murder weapons is quite disturbing tbh. Edited by melbourne_terrace: 16/10/2014 10:15:11 PM

Tbf, if he was driving a car and he ran over them it'd be no different. Just because your pissed/stoned doesn't excuse you for using your gun. Self defense is not a valid reason for discharging a gun in this country. -PB
