My understanding anyway. TBPH, I'm quite confused by the situation at the moment, but I've been trying to stay up-to date. Should Hicks and Gillet lose the case I can't see their appeal being successful. All it's going to do is prolong the situation and heap more misery on us, the supporters. I just wish these scum would fuck off.

I'm in a bit of a rush so I can't do a whole breakdown but I'll sum it up as best I can.
NESV made a bid for the club, which the board accepted. The board consists of Ian Ayre, Christian Purslow, Martin Broughton and the two cowboys. The Cowboys were against the bid, but they still lost 3-2 on the vote.
Hicks then came out saying that he had kicked Purslow and Ayre off the board, replacing them with his son and one of his business partners, therefore blocking the sale to NESV . Broughton then said that RBS had made the Cowboys sign papers stating that Broughton was the only person who could make changes to the board. Documents to this affect have been shown.
Basically this was the reason the whole thing went to court. RBS took Hicks and Gilette to court.
In the court case, the Cowboys admitted that they broke the contract! But said that they only did so because they had been excluded from the sale process, which is breaking the rules first.
They then came out with a whole bunch of statements to the affect that MB, CP and IA had been excluding them and were having a big old cry about it. MB and co then refuted this, showing evidence that Hicks and Gilette were refusing to show up to board meetings because they didn't want NESVs bid to be accepted, and not being left out by MB and co.
Cowboys are also saying that there were other, better bids than NESV that were ignored. Therefore, trying to dispute the claims from MB. Which is why Lim has made a bid, as well as Meriton, which owns half of Gilettes stake.
So yeah, that's a short summary of it I guess. I've missed a lot.

Also, irrespective of all of this, MBs QC was saying that if the Cowboys have a problem with the actions of the board, why don't they just attempt to sue for damages or whatever, instead of just stalling the sale process.
Our loans are due to be repaid on Friday, but as RBS are involved as a party in the case, it is very unlikely they would call in the loan until the case is settled.

If NESV deal goes through they lose 144mil. If they can get Lim's deal or Mill or Meriton deals then they wont end up so bad (I'm pretty sure)

I think Friday will b interesting to see if the RBS takes control of the club temporarily which could still see Kop Holdings go into administration and Pool deducted 9 points.

11.22am: Mr Justice Floyd has declined to grant an appeal. The judge said it would be inappropriate in the circumstances for him to grant leave. He said that if Hicks and Gillett are determined to appeal, they would have to apply to the appeal court for permission.
11.11am: Judge tells Hicks and Gillett it would be "inappropriate" to appeal. But that route does still remain open, although it is unclear what it could achieve with a board meeting by 8pm tonight.
Sachin says that the Liverpool/RBS barristers are now being cheered by the crowd outside.
THIS IS MASSIVE NEWS... will make it difficult now to get an appeal

We have the option to go back to Court on 21st October to get a declatory judgment, which NESV might want, but it wont impede the sale.

I think it essentially prevents future legal action surrounding the sale i.e. no further b/s will even be listened to by the courts

Even if they take the long way around to appeal, like you said Sydcro, the fact that there is a board meeting tonight means it wouldn't really accomplish anything, as sale will be completed before they could get the appeal listened to.

In the time that it would take for them to apply to the appeals court the deal will be done and dusted. 11.04am: Judge rules that owners should pay RBS costs. The RBS Team was a covernant between Brougton's lawyer, NESV's lawyer and RBS's lawyer. All on around 3k/hour. They had 6 days of preparation, 8 hour days, plus 5 hours of trial time yesterday plus 2 hours yesterday. That's approximately 495,000 pound that H&G have to pay in legal costs. Sensational result.
