there was sydney wanderers (a croatian and maltese club), but they merged.
i cant see much legal difficulties, as look how many united's there are in all the leagues.
i think lyall mentioned the legal difficulties may be if the word 'wanderers' is on a scarf by itself. though you can add a WS in front of it, thats the same colour at the scarf


Firstly the analogy you give doesn't apply.United is a common name and no-one has rights to it.The Wanderers name could be owned by some other club currently in existence .All they have to do is operate and trade with the name to claim some intellectual property right.West Syd will need to do proper due diligence to avoid potential problems.In this respect it is strange Strikers is an option when Brisbane has a Football club of this name and has national awareness.

The AFL tried to stop the new Rugby team being called the Bombers due to it being an iconic brand. Not sure how far it went but would have been surprised if they were successful.

Nobody owns strikers and I doubt anybody owns wanderers.

Brisbane Lions had to buy the name because there was already a Brisbane Lions. I imagine it will be the same if there is already a Wanderers club in west sydney.

There are many issues associated with TradeMark ownership.Rights are established by applying for registration or using the mark first.Many companies ,clubs etc use trade marks but never register.This creates a potential minefield.When you apply for registration you have to state what goods and services you wish to cover.This may result in clubs coverage being limited to their particular sport and sometimes to their area.Hence Essendon Bombers may not be able to stop an NRL club using a similar name.However the real problem is with selling merchandise.If you register the Trade Mark first you can stop a differrent sport selling the same merchandise.
As I said I am surprised if Brisbane Strikers haven't protected their brand.If they haven't ,maybe its because they also don't own it because many other people are using it or they just aren't aware of the registration system.Either way it is a potential problem for a new club.
Bottom line is it is very important for any new club to check the Trade Mark register and check if anyone is using a similar name.If not you are asking for trouble.Registering your Trade Mark is important to protect your rights in business.

I think a team name being chosen by the fans is a great talking point. It's probably a quicker way of getting the fans engaged so quickly. But I don't think the name should matter that much really, and it shouldn't mean they lose fans if certain people don't get the name they want. Wanderers seems like the most popular of the names left, and also sounds like it actually has some history behind it. I personally think West Sydney Athletic or even West Sydney Union sounds better, but that's just me. Just hope they sort this stuff out ASAP either way so they can start recruiting players sponsors etc. Time is ticking. They need to be competitive in year 1 no matter what.

Interesting....It was really going to be between Athletic and Wanderers really. I was always for Wanderers but the more I think of it I prefer Athletic. Anyways whatevs. Not my team, both good names which arent Americanised.

I hope you don't think we can just have a NSWPL all star team. We are going to need A-League experience, sure we need those players but probably 5 or 6, we need to be competitive from the start.
